Qualified Immunity is a legal doctrine that protects government officials from being sued for damages in civil court when they violate someone’s constitutional rights.
But should we really allow government officials to break our constitutional rights?
It turns out, there are many problems with qualified immunity including it creates incentives for officers to use excessive force without fear of punishment; it allows law enforcement agencies to escape liability by establishing policies that permit violations of constitutional rights, and it can lead to an inadequate investigation as well as the suppression or exclusion of exculpatory evidence.
